Terms of Service

1. Acceptance of Terms

By downloading, installing, or using MintDeck ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use MintDeck. If you are under 18, you must have parental or guardian consent to use the App. By using the App, you represent that you meet these requirements.

3. Account and Authentication

• MintDeck uses Sign in with Apple for authentication.
• You are responsible for maintaining the security of your Apple ID.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. User Content

Your Content

You retain ownership of all content you create in MintDeck (flashcards, decks, notes). By using the App, you grant us a limited license to store, sync, and process your content as necessary to provide our services.

Content Guidelines

You agree not to create or upload content that:

• Infringes on intellectual property rights of others
• Contains illegal, harmful, or offensive material
• Violates any applicable laws or regulations
• Contains malware or malicious code

5. AI Features and Third-Party Services

AI Processing

When you use AI-powered features (deck generation, image creation, smart suggestions), your content is sent to Google's Gemini API for processing. By using these features, you:

• Consent to your content being processed by Google's AI services
• Acknowledge that AI-generated content may not always be accurate
• Agree not to use AI features to generate prohibited content

Third-Party Terms

Use of AI features is also subject to Google's terms of service for Gemini API. We are not responsible for the availability or performance of third-party services.

6. Credits and Payments

Credit System

MintDeck uses a credit system for AI-powered features. Credits can be purchased through the App Store as one-time purchases (400 credits for $4.99). Credits never expire.

Credit Usage

Credits are consumed when using AI features:

• Deck generation: 1 credit per card generated
• Card enrichment: 1 credit per note
• Premium text-to-speech: 1 credit per card face
• Image generation: 3 credits per image
• PDF/document import: 10-30 credits depending on complexity

Refunds

All purchases are processed through Apple's App Store. Refund requests must be submitted through Apple. We cannot process refunds directly.

7. Intellectual Property

Our Property

MintDeck, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or reverse engineer the App.

Feedback

If you provide feedback or suggestions about the App, you grant us the right to use this feedback without restriction or compensation.

8. Disclaimers

• MintDeck is provided "as is" without warranties of any kind.
• We do not guarantee that the App will be error-free or uninterrupted.
• AI-generated content is provided for educational purposes and may contain inaccuracies.
• We are not responsible for any learning outcomes or academic results.

9. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of the App.

10. Termination

We may terminate or suspend your access to MintDeck at any time, without notice, if you violate these Terms or for any other reason. Upon termination:

• Your right to use the App ceases immediately
• We may delete your account and data
• Purchased credits are non-refundable

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction where we are located, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.
